Terms of service

1. Provider, Scope  

- Provider: WVG Distillery, Peter Klewinghaus, Schulstraße 10, 69469 Weinheim, Germany.  

- These terms and conditions apply to all orders placed via the online shop between WVG Distillery, Peter Klewinghaus, and consumers with a delivery address in Germany.


2. Contracting parties, Conclusion of contract  

- The purchase contract is concluded with WVG Distillery, Peter Klewinghaus.  

- Product representations in the shop are non-binding invitations to submit an offer. By submitting an order, the customer makes a binding offer. Acceptance occurs by order confirmation or delivery of the goods.


3. Contract language, Storage of the contract text  

- Contract language is German.  

- The GTC are stored on the website; the complete contract text is not stored for data protection reasons. Order details will be sent to the customer by e‑mail.


4. Products, Prices, Shipping costs  

- All prices are inclusive of statutory value added tax and plus shipping costs, unless stated otherwise.  

- Shipping costs are shown separately in the shopping cart and during the order process.  

- Offers are valid while stocks last.


5. Payment terms  

- Accepted payment methods: advance payment (bank transfer), PayPal, credit card, debit card.  

- For advance payment, the goods will be dispatched after receipt of payment.


6. Delivery, Delivery area, Delivery times  

- Delivery is made only within Germany.  

- Delivery times are indicated for each product or during the ordering process. Delays will be communicated without undue delay.


7. Retention of title  

- The delivered goods remain our property until full payment has been received.


8. Warranty and liability for defects  

- The statutory warranty rights apply.  

- Obvious defects must be reported in writing without undue delay, no later than 14 days after receipt of the goods.


9. Limitation of liability  

- For slightly negligent breaches of duty we are liable only for the breach of essential contractual obligations (cardinal obligations). Liability is limited to the typically foreseeable damage.  

- Liability for intent, gross negligence and for personal injury remains unaffected.


10. Age verification and youth protection  

- Sale of alcoholic beverages only to persons at or above the legally permitted minimum age.  

- The customer warrants they have reached the minimum legal age when purchasing. If there are indications of minority, we reserve the right to reject the order or to carry out an age verification procedure (e.g., identity check upon delivery).


11. Right of withdrawal / Cancellation policy  

- Consumers have a right of withdrawal under distance selling law. However, goods that spoil quickly or are unsuitable for return for reasons of health protection may be excluded. Alcoholic beverages whose price depends on fluctuations in the market and which are delivered after conclusion of the contract may be excluded from the right of withdrawal if this is expressly agreed in the individual contract.  

- A separate cancellation policy with the withdrawal period, consequences of withdrawal and a model withdrawal form is provided on the website.


12. Costs of returns  

- In the event of withdrawal, the consumer bears the regular costs of returning the goods if the delivered goods correspond to the ordered ones.


13. Data protection  

- Information on the processing of personal data can be found in the privacy policy on our website.


14. Online dispute resolution information  

- The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr  

- We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.


15. Final provisions, Applicable law, Jurisdiction  

- German law applies excluding the UN Convention on Contracts for the International Sale of Goods (CISG).  

- For consumers, the statutory place of jurisdiction of their residence applies if it is located in Germany. Otherwise, the place of jurisdiction is, where permissible, Weinheim.


16. Severability clause  

- Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
